At SF Tech Week on October 7, Landfall IP founders Nathan Mutter and Michael Drapkin led a roundtable on how AI impacts the patent process for founders.

AI can help founders in real ways. It can explain how patents work in plain language, help you describe your invention clearly, and turn rough notes into an organized draft. All of that makes the work that follows faster and better.

But there are pitfalls worth knowing.

It drafts what you describe, not what matters. AI writes claims around whatever you tell it. It does not know which feature a competitor would actually need to copy.

It doesn’t know your timeline. A launch, a demo day, or a public talk can impact your patent rights, especially outside the U.S. A draft won’t warn you.

It doesn’t know your business. Whether to patent something or keep it a trade secret, and whether the claims fit where your product is going, depend on your plans, not the text.

It sounds confident when it’s wrong. A polished draft can still have claims that are too narrow, too broad, or not supported by the description. Those problems are hard to spot, and once the application is filed, they are hard to fix.

Our advice is simple. Use AI to learn the basics and get organized. Get experienced judgment on the decisions that are hard to undo.
